Terms and Conditions

1. Acceptance of Terms

By downloading, installing or using the ATLAS mobile application (the "App") or signing in to tfdcoaching.nl (the "Website"), both operated by TFD Coaching ("we", "us", or "our"), you agree to these Terms and Conditions. If you do not agree, please do not use the App.

Our Privacy Policy explains how we handle your personal data.

2. Description of Service

ATLAS is a workout tracking application that allows you to:

• Create workouts and track exercises, sets, reps, weights, hold times and effort
• Follow structured, multi-week training programs
• Progress through exercise variations and skill levels
• Set goals and review your progress and workout history
• Connect with friends, share workouts, and like and comment on friends' workouts
• Sync and back up your data across devices, and view it on the Website

Some features are only available with a paid subscription (see section 4).

3. Accounts and Guest Use

You can use the App as a guest without creating an account. Guest data cannot be recovered if you sign out, discard it, or lose access to the device. Create an account to keep your data safe and to use social features.

If you create an account, you are responsible for:

• Keeping your sign-in credentials confidential
• All activity that occurs under your account
• Providing accurate information, and choosing a username that does not impersonate others or infringe their rights

If you are under 16, you need the permission of a parent or guardian to create an account or buy a subscription.

4. Subscriptions

ATLAS is free to use, with optional paid subscriptions ("ATLAS Pro") that unlock additional features. The features included and the current prices are shown in the App before you buy.

• Payment: subscriptions are purchased through the Apple App Store or Google Play and are charged to your App Store or Google Play account when you confirm the purchase
• Automatic renewal: a subscription renews automatically at the end of each period at the then-current price unless you cancel it at least 24 hours before the end of the current period
• Cancelling: you can manage or cancel your subscription at any time in your App Store or Google Play account settings. After cancelling, you keep access until the end of the period you have paid for. Deleting the App or your account does not cancel a subscription
• Free trials: if a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends
• Price changes: we may change subscription prices. You will be notified in advance as required by Apple or Google, and a new price applies only from your next renewal
• Refunds: purchases are processed by Apple or Google, and refund requests are handled by them under their refund policies

Right of withdrawal (EU): a subscription gives you immediate access to digital content. By starting a subscription you request immediate access and acknowledge that you lose your 14-day right of withdrawal once access begins, to the extent permitted by law. This does not affect any refund you may be entitled to from Apple or Google.

If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies to your use of the App.

5. Acceptable Use

When using the App, you agree not to:

• Use the App for any unlawful purpose
• Harass, abuse or harm other users through social features
• Post offensive, inappropriate or misleading content, or content you do not have the right to share
• Impersonate another person
• Attempt to gain unauthorised access to the App, its systems or other users' data
• Interfere with the proper functioning of the App
• Use automated systems or bots to interact with the App

6. Health Disclaimer

The workouts, programs and exercises provided through ATLAS are for general informational purposes only. They do not constitute medical advice and are not a substitute for professional medical or fitness guidance. Consult a qualified healthcare professional before starting any exercise program, especially if you have a medical condition or injury.

Exercise carries a risk of injury. Use proper form, train within your abilities, and stop immediately if you feel pain, dizziness or discomfort. You use the App and follow its programs at your own risk.

7. Intellectual Property

All content, features and functionality of the App, including but not limited to text, graphics, logos, workout programs and software, are the property of TFD Coaching or its licensors and are protected by intellectual property laws.

We grant you a personal, non-transferable licence to use the App for your own non-commercial training. Programs delivered to you personally as part of coaching are for your own use only. You may not copy, modify, distribute or create derivative works based on any part of the App without our prior written consent.

8. User Content

You keep ownership of the content you post through the App's social features, such as workout posts, comments and your profile picture. By posting it, you grant TFD Coaching a non-exclusive, royalty-free licence to store and display that content within the App for the purpose of providing the service.

We may remove content that violates these Terms.

9. Ending Your Account

You can delete your account at any time in the App under Settings → Delete Account. This permanently deletes your account and its data, as described in our Privacy Policy.

We may suspend or terminate accounts that violate these Terms. Where reasonable, we will tell you why and give you an opportunity to respond.

10. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available", without warranties of any kind
• TFD Coaching is not liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the App
• TFD Coaching is not responsible for injury resulting from exercises performed based on App content
• Our total liability is limited to the amount you paid for the App in the 12 months before the claim

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for damage caused by our intent or gross negligence, or any other liability that cannot be limited or excluded under applicable law. Your statutory rights as a consumer are not affected.

11. Modifications to the Service

We may modify, suspend or discontinue the App (or any part of it) at any time. If we discontinue a paid feature during a subscription period you have paid for, we will give you reasonable notice where possible.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by other appropriate means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Disputes are subject to the jurisdiction of the competent court in the Netherlands. If you are a consumer living elsewhere in the EU, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in its courts.
